Terms of Service

These terms are an agreement between you and Matchsticks (matchsticks.online) — "we" or "us" — covering your use of the Peanut Gallery Chrome extension, website, and related services (together, the "Service"). By installing the extension or creating an account, you agree to these terms.
1. The Service
Peanut Gallery lets you create projects for websites you're working on, invite collaborators with a one-time code, and collect comments pinned to specific elements of a live page. Comments sync through our cloud backend so everyone in a project sees the same feedback.
2. Accounts and invite codes
- You must provide accurate account information and keep your password secure. You're responsible for activity under your account.
- Invite codes admit anyone who has them to the relevant project. Share codes only with people you want in the project.
- You must be at least 16 years old to use the Service.
3. Your content
- You (and your collaborators) own the comments and content you create. We claim no ownership.
- You grant us the limited licence needed to store, display, and sync that content — that's what makes the product work — and nothing more.
- You're responsible for what you and the collaborators you invite post. Only run reviews on websites you have the right to access and review.
4. Acceptable use
You agree not to:
- Use the Service for anything unlawful, or post content that is defamatory, infringing, or malicious.
- Attempt to breach, probe, or overload the Service or access other users' data.
- Reverse engineer the Service except where the law expressly permits it.
- Resell or white-label the Service without our written agreement.
5. Plans, billing, and cancellation
- The Free plan includes 1 project, 20 comments per project, and 1 collaborator. Plus ($12/month) and Premium ($29/month) raise or remove those limits, as described on our pricing page.
- Limits are enforced per project according to the project owner's plan — collaborators you invite inherit your limits inside your projects.
- Paid plans bill monthly in advance and renew automatically until cancelled. You can cancel any time; your plan stays active until the end of the paid period. Except where the law requires otherwise, payments are non-refundable for partial months.
- If a payment fails and remains unpaid, we may downgrade the account to the Free plan after reasonable notice. Content beyond Free-plan limits is retained for a reasonable period but may become read-only.
- We may change prices with at least 30 days' notice; changes apply from your next billing cycle.
6. Our property
The Service — including the extension code, design, wordmark, and peanut — belongs to us or our licensors. These terms don't grant you any rights in it beyond normal use of the Service.
7. Third-party services
The Service depends on third parties, including the Chrome Web Store, Supabase (authentication and data), and our payment processor. Their terms apply to their services. We're not responsible for third-party services we don't control.
8. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that breach these terms, create risk for other users, or abuse the Service — with notice where practicable. On termination, sections that by their nature should survive (your content responsibilities, disclaimers, liability limits) survive.
9. Disclaimers
The Service is provided "as is" and "as available". We work hard to keep it fast and reliable, but we don't warrant that it will be uninterrupted, error-free, or fit for a particular purpose. Feedback collected through the Service is your and your clients' responsibility.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim (or, if you're on the Free plan, USD 50).
Nothing in these terms limits liability that cannot be limited by law, and if you're a consumer you keep all mandatory statutory rights.
11. Changes to these terms
We may update these terms as the Service evolves. For material changes we'll update the date above and give notice by email or in the extension. Continued use after changes take effect means you accept them.
12. Governing law
These terms are governed by the laws of the Republic of South Africa, and disputes fall under the jurisdiction of its courts — without limiting any mandatory consumer protections you enjoy where you live.
